of Appeals made the right decision in upholding the state law that relates
to this issue.

STATEMENT BY SENATOR THOMAS K. DUANE ON COURT OF APPEAL’S DECISION TO DENY
CIVIL MARRIAGE FOR SAME-SEX COUPLES

“Today is a shameful day in New York State’s history. It was my
sincere hope that the Lesbian, Gay, Bisexual and Transgendered (LGBT)
community would be granted the right of civil marriage in a dignified
ruling by our courts stating that the equal protection clause of the New
York State Constitution protects all of our citizens. It is my firm belief

STATEMENT BY SPEAKER CHRISTINE C. QUINN Re: New York State Court of Appeals' Gay Marriage Decision

STATEMENT BY SPEAKER CHRISTINE C. QUINN
Re: New York State Court of Appeals Gay Marriage Decision

Today, the Court abdicated its role to enforce New York's Constitution and ensure equal rights for all New Yorkers. It is a deeply disappointing decision. As Judge Judith Kaye wrote in her dissent, "I am confident that future generations will look back on today's decision as an unfortunate misstep."

The New York Court of Appeals has a long tradition of protecting equal rights for New Yorkers. But today the Court let us down, and it is a sad day for families across the State.

I believe that same sex couples do have a right to marry as a matter of fundamental fairness and equality, and I am optimistic that justice will ultimately prevail. The Court made it clear that it is up to the State legislature to address the inequality in our marriage law. It is time now for Albany to act, and to act quickly, to provide equal protection for all New Yorkers. I call on State lawmakers to put civil rights before politics. Together with other elected officials and the LGBT community, I will lobby the Assembly, the Senate, and the Governor to ensure our laws treat all people equally.
