The fix, as they say, is in. This gross exercise in cronyism is calendared for Friday at the party's judicial nominating convention, a rigged affair that will blatantly violate the constitutional rights of the borough's voters. The federal courts have so ruled, but Lopez is proceeding smarmily apace, party insiders say. And even some of them are appalled that Lopez intends to elevate Civil Court Judge Jack Battaglia to the Supreme Court bench while cohabiting with Battaglia's sister Angela. Pataki plans to nominate the daughter of Assemblyman Vito Lopez, the Brooklyn Democratic chairman who has been cozy with Republican leaders, to a lucrative, long-tenured post on the state Court of Claims, The Post has learned. Pataki, a lame-duck Republican who has been rushing to fill hundreds of positions before he leaves office at the end of the year, will nominate Gina Marie Lopez-Summa to the prestigious $137,000-a-year post, as payback for Assemblyman Lopez's repeated willingness to break party ranks and back the governor for reelection, said a high-level state official. "Vito has been more loyal to Pataki than he has been to the Democratic Party," the official said. Assemblyman Lopez did not return a call seeking comment. --------------------------- During the last 6 months I had come to believe that Room 8 was populated by progressive intellectuals and reform-minded activists of Park Slope, Brooklyn Heights and other parts of Brooklyn. With the exception or a few County troglodytes. For this reason, I anticipated that the current lively gay repartee would give way to quick reaction against a judicial coup being pulled off by Vito Lopez and his hacks. But to my surprise, only one blogger, YODA, thought the matter worth attention. And YODA criticized the News editorial, while applauding Vito’s choice as a gift from Heaven. The views of Park Slope and Brooklyn Heights liberals Room Eight were suddenly and shockingly missing in action. Yoda was the one who published parts of the Daily News article editorial and boldly proceeded to tear it apart while supporting Vito’s choice. And the only response to County Yoda was an Anonymous poster who also supported Vito, and proceeded with a strange attempt at “outing” Judge Battaglia. The other judges keep trying to find guys to fix him up with just so he'll stop talking to them about the Uniform Commerical Code. If this is Vito's idea of nepotism then bring on Gina!” ------------------------------------------------------ A few comments. The New York City Conflict of Interest Law prohibits elected officials and government employees from hiring or promoting relatives and domestic partners or being involved in their promotion or hiring. These strict laws impose not only fines, but dismissal, and criminal sanction for government employees who violate them. It’s true that these rules do not apply to the selection of judges. But clearly they should or there should be some standard of integrity imposed on the nomination process. There is no acceptable reason why the bar for selection of judges should not be as high, and in fact, higher than for cops, sanitation workers, teachers and other government workers. It is true that Vito is not a blood-relation of Jack Battaglia, but he can be considered his brother-in-Law, since according to the Daily News, the County Leader is living with Battaglia’s sister, Angela. And that relationship is enough to be considered a violation of the spirit of New York City’s COB rules. Moreover, YODA’s suggestion that Jack Battaglia is a special gift to Brooklyn’s courts is belied by the resume presented. It is possible that Battaglia may have served competently during his 3 or 4 years as a Civil Court judge. But this man’s resume is a very ordinary one, without special scholarship, and no history of any type of community service. And it’s hard to believe that there are not equally qualified Civil Court judges with more than the minimal longevity Battaglia carries. There is another troubling issue here. Although Vito changed his name from Lopesino and became Lopez to run in a Latino district, the County Leader appears to be more interested in the nomination of Italian candidates than Latino candidates. For example, Vito pulled out all the strings in his attempt to block Margarita Lopez Torres from becoming the first Latina Surrogate Court judge in New York State. At the same time, Vito was among the group who secretly arranged for Frank Seddio, a landlord-tenant lawyer with no type of judicial experience to be nominated as a second Surrogate Court Judge without facing a primary election. And now the New York Post article indicates that Governor Pataki will appoint Vito’s daughter Gina Summa to the Court of Claims. Incidentally, isn’t this the same Gina whom Clarence and Vito were accused of trying to force upon Judge Lopez Torres as her Law Clerk? Ugliest of all, Fred Dicker’s Post article carries statements which indicate that County Leader Lopez has shamelessly picked up an appointment for his daughter by being a traitor to the Democratic Party. How in the world do Brooklyn’s elected officials take orders from a traitor to their Party who now orders them to be loyal. Meanwhile, according to information, Dov Hikind, a confirmed racist and another traitor to the Democratic Party has already secured the appointment of his candidate for State Supreme Court Judge. What becomes clear is that County Leader Vito Lopez is committed to an aggressive Italian American Affirmative Action and Family Plan. At a time when Black and Latino judges are finally being elected to City-Wide Civil Court positions, Vito has decided to go against the wishes of the majority of the voters, and may succeed in having three Italian/American judges appointed within one year. Two of them related to him. The nomination of State Supreme Court judges on Friday will signal to Brooklyn whether Vito Lopez is even worse than Clarence Norman. It should also be followed by the initiation of a new Reform Coalition which excludes traitors to the Democratic Party, and demands high and untainted standards for judicial candidates. The NYC Conflicts of Intertest Law has absolutely NO application to the judicial selection process of a political party. Sorry to intervne with a fact.

Wasn't that Richard Velazquez fellow that Lopez broke his ass electing against "Reformer" choice Martin Needleman...not a hispanic jusging by his name and Yarmulke...a Latino? I understand taht the other likely judicial candidated to be selected will be Delores Thomas, another Judge of fine repute. Where is the commentary on the attempts of Al Vann and Annette Robinson to pay off on Clarence Norman's debt by elevating Paul Wooten to Supreme instead of Thomas...as a reward for dropping out of the DA's race last year to unite Black voters behind Sampson? And where is the credit to Vito Lopez for not having any part of that corrupt and disgusting deal. Or does it just revile people when it is ni the name of Vito or County when such an allegation is made.

Perhaps the reason that you don't see any righteous indignation is because the candidates being selected are QUALITY candidates, approved by an Independent Screening Panel.
Finally, why no mention of the hypocrisxy of the Daily News and reformers in failing to mention that the Pataki appointment of Vito's daughter, should it happen, is an appointed Judge under just the system they are seeking. "Merit" selection is always filled with poolitics and politics that is often far beneaththe rocks.
JUust remember, Eliot Spitzer won't always be Governor assuming that he wins. We would have had George Pataki appointing right wing Republican hacks to the Supreme Court for the past decade and no one, not one voter, not one political leader that could be touched, could have been brought to task for it.
Be careful what you wish for and be mindful of full and fair comment when criticizing. Paul Wooten should be appointed a judge on merit. Look at his record.
Paul Wooten would certainly be a fine judge, but if he gets the nod, merit will have nothing to do with it. It will be for the corrupt reasons outlined above.

Nowhere in my item did I suggest that Jack Battaglia is a special gift to Brooklyn’s courts. I explicity said that I am supremely ignorant about who would or would not be a good judge. My point was that I think the editorial writers at the News probably know as little as me about Battagila and that it was unfair to attack him so harshly. On some other points, I think we should all be amused that Pataki is appointed Vito's daughter as this avoids 2 worse alternatives - Pataki appointing a hack Republican instead of a hack Democrat and Vito attempting to get his daughter a Civil or Supreme Court slot from Brooklyn in the next few years. Regarding the issue of ethnic diversity, didn't Vito support and help elect 2 Black women to Civil Court last week over 2 Italian men? Didn't he support a Black women for Surrogate last year over a Jewish man. And wasn't the Vito the person who plucked the sainted Margarita Lopez Torres out obscurity and pick her to get a unopposed Civil Court judgeship? Maurice did you say in your blog that you made a deal to support Vito's judges in return for support of a candidate that you were working for against Gordon? Clarence Norman and Jeff Feldman were indicted because the DA claims that the County leader's support for Civil Court candidates is something of value. No people are saying Lopez' support for Civil Court candidates was worthless. Clarence & Feldman should call 10:19 & 10:59 as witnesses.
This post is pretty gross. I read r8ny.com because I feel like I can learn a little about NYC politics, but this kind of paranoid personal attack is a little too much for me. Since reading this blog I have seen people's comments zapped for saying things very similar to what Mr. Gumbs states above, but this goes out without any editorial oversight. It just seems petty and irresponsible. Mr. Gumbs, if you feel so strongly about all this, why not run for office yourself?

It has probably raised their interest and speculation(not mine) as to your identity. I know you must find what I have said about Vito to be aggravating, and somewhat threatening. But I think it would make for more meaningful dialogue if you and other Vito allies really pay attention to what other posters are actually saying. 10:19 above said that it was clear that "two Black women were going to win those two County-wide positions." Again, the fact is that no matter what Vito did or said, or didn't do or didn't say, on the evening of September 12, two Black women were going to emerge as the winners. And all four of these Black women knew that two of them would win. That's why they were willing to spend their money. Vito gets no credit for it. If he wanted to be a champion for Blacks and Latinos, he could have used his influence to get Pataki to appoint Blacks and Latinos to the higher Courts. The racism of Pataki's judicial appointment is incredible. But Vito, instead has made it a selfish personal ethnic and family affair when it comes to current appointments. Moreover, Yoda, the truth is that all four of these Black women wanted and hoped to get the County endorsement. The people who were backing these ladies were all solid County people. Even their poster thugs were County people. Tahaka Robinson, Musa Moore, and Omar Boucher have always been basically part of Clarence's operation. This was strictly an "intra-County" struggle. None of these Black judicial candidates were part of any Reform-movement or insurgent struggle. So no matter which of them you and Vito supported, you were really supporting "insiders. And no matter which of them Evans supported, he would be supporting County candidates, even though only two got the official endorsement. Do you understand now, Yodas?

No one outed Jack B. He is already out. And, as no one will tell you different, he is a great judge.
Hikind is what he is, but his candidate, David Schmidt, is both a social liberal, and almost universally acknowledged as one of the best judges in Brooklyn. He is already an Acting Supreme by merit selection.
On the merits, these guys are both highly qualified. No one will say different.
As Gatey pointed out, to oppose somone qualified because of their political connections is to commit the same sin normally indulged in by the Regulars. In this case, the Regulars are doing the right thing for the wrong reasons, but that is far better than what they usually do, so why complain.
Let's see what the Regulars do with the other slots. There may yet be an opportunity for a substantive complaint, but Battaglia and Schmidt don't present it.
