JUDGE JOHN L. PHILLIPS - JUSTICE HAS NOT BEEN SERVED
Justice has not been served in the case of my dearly departed friend, the Honorable Judge John L. Phillips, known to all as the Kung-Fu Judge. Upon learning of his candidacy in 2001, Brooklyn D.A. Joe Hynes filed an ex-parte (secret action) to seal up all of Judge Phillips' assets. Twelve apartment buildings and two movie Theatres were part of the millionaire judges' empire. The Court then appointed Hynes former Chief of Staff, Harvey Greenberg, as Judge Phillips' "Guardian."
Judge Phillips was then remanded to a nursing home...in the BRONX, and the race for District Attorney was over. All of Judge Phillips' properties were sold for pennies-on-the-dollar. Then the judges' home mysteriously burned to the ground, obfuscating any records he had been keeping. The guardians neglected to pay the insurance. Six years later, the once museum-like four story brownstone at 155 Herkimer Street still sits in the heart of Bed-Stuy as a boarded up shell. A monument to the tragic end of the Kung-Fu Judge. Now, the undisputed facts, according to the IRS, are that between the years of 2000 and 2007, four separate guardians sold $10 million dollars of Judge Phillips' property and failed to pay or file any taxes. The IRS now wants $3 million in unpaid taxes from Judge Phillips' estate. The only item left in the estate is the Slave Theatre, which is worth close to 3 million dollars. The four guardians, all attorneys, are: 1. Harvey Greenberg (former chief Assistant District Attorney to D.A. Hynes); 2. Frank Livotti 3. Raymond Jones 4. Emani Taylor The sale of Phillips' properties was absolutely unlawful and illegal, so why not rescind those sales, restore those properties to the estate of John L. Phillips, and transfer the burden of those unpaid taxes to those four "guardians" who fattened themselves on the fat of Judge Phillips' properties? I would liken those "guardians" to the many suitors of Penelope, Odysseus' estranged wife in the Odyssey, while Poseidon kept the hero away from home. I'm proud to announce that attorney John Kennedy O'Hara has a $10 million lawsuit pending against the nursing home that held Judge Phillips hostage on the orders of DA Hynes. O'Hara also met with federal agents from the IRS last week concerning a criminal probe regarding Phillips' properties, and those four guardians who "forgot" to pay the taxes on the 10 million dollars. The undisputed facts of the case: Judge John L. Phillips, died homeless and broke. He owned 12 apartment buildings and 2 movie theatres. The Brooklyn D.A. seized his assets because Judge Phillips was planning to run against him in 2001. D.A. Hynes got the courts to appoint his former chief of staff as a guardian. All 4 guardians sold all of Judge Phillips' buildings, and kept the money. These facts are not in dispute. I've read the court documents. The New York Times, New York Post, Brooklyn Paper, and The New York Sun ran a series of articles. It seems that Hynes, playing the part of Poseidon, was successful in his campaign to kill our hero, Judge John L. Phillips, and the suitors have all but eaten his property. Can John Kennedy O'Hara, playing the part of Telemachus, bring some modicum of justice to the estate of Judge Phillips? May we see justice served to the legacy of Judge John L. Phillips, the Kung-Fu Judge of Brooklyn, beloved by his tenants, his friends, and this writer. Hynes Bagman Harvey Greenberg has a power of attorney to handle all real estate transactions for Hynes and his wife. Hynes is supposed to be living off a govt paycheck. How many real estate purchases could him and his wife be involved with ? Harvey Greenberg was counsel to my father in a guardianship proceeding. He conducted similiar tirades 1999 - to my father's death in 2000.
Four lawyers dont pay taxes on 10 million doallars ? After reading that, why would anyone pay taxes !! If the pattern is that the guardians didnt pay taxes, than what about the other 150 cases like Judge Phillips. This looks like a ulti millin doaller tax scam that Hynes is covering up. To me, the failure to pay taxes is the least of the abuse. As I write this post, there are thousands of victims, some of whom are physically and mentaly fine, that are being declared incompetnt by judges and assisted by lawyers under the guise of appointing a guardian to assist them, when in fact the sole purpose is to take as much of the victim's money and property as possible. Many lawers charge up to 400 dollars an hour for things like making phone calls, writing letters, etc. Motion after motion, hearing after hearing... slowly eroding the victims hard earned nest egg... All the dailies published dozens of articles up untill Judge Phillips died homeless and broke in 2008, but Errol never wrote another word So if the DA orchestrates the looting of Judge Phillips assets, than who prosecutes the prosecutor ? Some people are above the law !! Story says the DA videotaped the raid on Judge Phillips house. AARP is the second largest magazine in the world. Am I missing something ? Hey Newswatch - the 4 guardians weren't just in AARP. They were in the New York Times and Post. Either the IRS can't read a newspaper, or being the DA's friend means never having to pay taxes. I read in the NYT's that Sharpton got his start having rallies at the Slave Theater. But Sharpton turned his back on Judge Phillips. I guess it's easy to attack cops, but taking on the DA is not in Al's interest. A dozen buildings stolen. The IRS gets stiffed for millions. And Judge Phillips died homeless. If it can happen to a Judge, it can happen to you.
In a civilized society, our courts are the place to settle our disputes. When the Courts fail, as it did for Judge Phillips, than we are all doomed to fail. Millions of doallars in property is seized by the Brooklyn DA's office and sold in unpublished auctions - and the court appointed guardians keep the money. This can only happen with Judges like Michael Pesce being in on it. A cousin of his bought one of Judge Phillips buildings. Breezy Point Joe, here is thy legacy. I lived lived in Judge Phillips' buildings for 7 year years. Also. I was one of his close associates. I can tell you from experience he was one of the biggest slum lords in NYC; written about in all of the major NYC newspapers. He did nothing to maintain any of his dilapidated properties, we lived like third world peasants. His justification for refusing to care for his tenants was that, the properties were all under rent control. He would regularly evict tenants illegally by renting out their apartments while they still lived in them. Speak to his ex-tenants and they will tell you the horror stories. Furthermore, Judge Phillips suffered from dementia, and it was obvious to everyone around him; esp. his associates. To the people who kissed his ass and held him up as a Black hero he was just an eccentric old man. In his own home he lived like a pig, with cat manure all over the place - even in his bed. His home had peeling paint on the the cracked plaster walls, and holes in the wooden parqeut floors. He constantly gave hundreds of dollars of his money away to con men who fooled him into thinking he would benefit from some hairball. crazy, illegal scheme. The man was completely incompetent as a lawyer and a judge. He would walk around for weeks with urine stains in his slacks, smelling like a person who hadn't taken a shower in months. Hynes did him a favor by putting him under guardianship. If he hadn't Judge Phillips would have probably signed all of his property over to the crooks and con artist who hung around him. As for what the attorneys in question, what they did with his properties, it was definitely wrong ansd shameful. They should be disbarred and prosecuted to the full extent of the law. His surviving distant relatives should received all of his assets Lastly, at one time Judge Phillips was a shining example of the Bed-Sty community. He did favors for many residents, and tried to build institutions of Black pride (movie theatres) in the community. But unfortunately about 15 years before he died the dementia sent him down a dark & reckless path that could have been more personally catastrophic for him than winding up in a nursing home.
